1. Definitions

"Be Fitter Club" / "we" / "us" / "our" refers to the business operated.

"You" / "Client" / "User" refers to the individual using our website or services.

"Services" means all coaching, memberships, programs, consultations, digital content, and events provided by Be Fitter Club.
2. Services Overview
Be Fitter Club provides:

Personalised fitness coaching and training plans

Weekly membership plans with support

Event-based or group training experiences
-
One-time, fully tailored programs for specific goals (e.g., HYROX, Marathon, Triathlon)

Personal training, mental coaching and recovery treatments.
3. Eligibility
To use our services, you must:

Be at least 18 years old

Be medically fit to participate in physical training

Provide accurate and current personal information
It is your responsibility to consult a physician before beginning any fitness program.
4. Payments & Pricing

Prices are listed in euros (EUR) and may include VAT where applicable.

Full payment is required in advance for one-time programs.

Weekly memberships are billed in advance on a rolling basis.

You are responsible for ensuring payment details are accurate and up to date.

We reserve the right to update pricing at any time, with reasonable notice for current members.
5. Memberships & Cancellations

Memberships such as Strength Club, Hybrid Club, Coaching Membership, and Fuel Membership are billed every 4 weeks and require a 4-week cancellation notice. Cancellations must be submitted in writing via email or WhatsApp.

Personalised Sport Journeys (including HYROX, Marathon, Triathlon, and Pro Athlete programs) are billed weekly and require a minimum 1-week cancellation notice before your next billing cycle. This allows time to pause or stop your plan without being charged for the following week.

Missed sessions, events, or periods of inactivity do not entitle you to a refund or time credit.

All event participation costs (e.g., food, gear, entrance tickets) are borne by the participant unless stated otherwise.
6. Refunds

Due to the custom nature of the service, we do not offer refunds once your plan has been created and delivered.

Memberships: No partial refunds for unused weeks. Cancellation ends future billing after the notice period.
If you are unsatisfied, please contact us directly to discuss a resolution.
7. Use of Services & Conduct
You agree to:

Follow the training and safety guidance provided

Respect the community space (online and in-person)

Not misuse the platform or attempt to copy, resell, or distribute any part of our programs
We reserve the right to terminate services if abusive, harmful, or unethical behavior is displayed.
8. Limitation of Liability
While every effort is made to ensure safe and effective programming, you accept full responsibility for your health, physical condition, and actions. Be Fitter Club is not liable for:

Injuries sustained during training or events

Loss or damage to personal items

Consequences arising from misuse or misinterpretation of training advice
You participate at your own risk.
9. Intellectual Property
All content created by Be Fitter Club (including training plans, videos, logos, branding, written materials, and online content) remains the intellectual property of Be Fitter Club. You may not reproduce, share, or publish this content without prior written permission.
10. Communication
By purchasing a service, you consent to receive communication via email or WhatsApp for coaching, service updates, and relevant information.
You can opt out of marketing messages at any time, but service-related messages are necessary for the delivery of your plan.
11. Privacy & Data
Your personal data is collected and stored in accordance with our Privacy Policy. We take GDPR compliance seriously and only use your information for the purpose of delivering services and improving your experience.
12. Changes to Terms
We may update these Terms & Conditions from time to time. Any changes will be posted on our website, and your continued use of our services indicates agreement with the revised terms.
13. Governing Law
These terms are governed by Dutch law. Any disputes will be handled by the competent courts of the Netherlands.
